Can you divorce for adultery after separation?
Under s. 11(2) of the Divorce Act, an act of adultery or cruelty that has been condoned cannot be used as a ground for divorce. As long as you’re married, having sex with someone who isn’t your spouse counts as adultery. If you’re separated at the time however, no one except your in-laws or the Pope is going to care.
Can you divorce someone if you don’t know where they are?
It is possible to apply for a divorce without knowing the location of your spouse. If you do not know the whereabouts of your spouse you can apply to the Court for substituted service or dispensation of service as long as you can show the Court that you have made attempts to contact your spouse.
