Can you file for child support after divorce is final?
You can ask Child Support to collect your maintenance once an order is made. You can apply for maintenance at any time. However, you must apply for maintenance within 12 months of your divorce becoming final for married couples or within 2 years from the date of separation for de facto couples.
Can you get back child support without court order?
Retroactive support is ordered when there is no prior agreement or court order in place. This may be a retroactive increase to an existing obligation, or a brand new request for support. A payor may also ask for a retroactive change to a support order, i.e. to not have to pay money they were required to pay.

If you disagree with a decision made by the Department of Human Services (Child Support), you can lodge a written objection with them to have the decision reviewed. If you are appealing a child support decision and you can’t afford to keep paying the required amount, you may need to apply for a stay order.
