What to do when you want a divorce but spouse does not?
If you properly served the divorce petition and your spouse filed an uncontested response, but won't sign off on the final divorce papers, courts in some states may allow the case to proceed as though it's uncontested. You may wait to be assigned a court appearance date.
Can a spouse take everything in a divorce?
The unfortunate reality is that he/she may certainly try to take everything, or at least an unfair share. The rule is that the community property must be divided 50/50, according to “no fault” principles. Each spouse has a fiduciary duty to disclose all assets (and income, expenses and debts).
What happens if one person doesn’t want to get divorced?

As long as the necessary financial and legal issues get resolved, the divorce can be completed with one person never agreeing to it. However, the negotiation of these issues does offer a potential block to completing the divorce.
