What is conclusive evidence?
Evidence that must, as a matter of law, be taken to establish some fact in issue and that cannot be disputed. For example, the certificate of incorporation of a company is conclusive evidence of its incorporation.
What is an example of prima facie?
The definition of prima facie refers to the way something looks on its face, or at first glance. An example of prima facie is when a wife walks in on her husband with another woman; at first glance, it looks as if he is guilty of something just because of the circumstances.
Is a statement enough evidence?
An admission by a defendant by itself is not sufficient evidence to prove guilt. The proscution needs additional evidence. If someone says “I murdered her”, that statement alone cannot convict the defendant. If the prosecution has a dead body, the evidence of the body and the statement is enough for a conviction.
Can you withdraw evidence?
The police might try and talk you out of it. If you withdraw your statement, the case might still go to court if the police think they have enough evidence to prosecute the suspect.
