Does child support automatically stop in Texas?
In Texas, child support payments must continue until a child is emancipated. Under Texas law, emancipation takes place when a child reaches the age of 18. Also, if a child gets married prior to being emancipated or moves into the residence of the non-custodial parent, a motion to stop paying child support may be filed.
What can I do if the non custodial parent doesn’t pay child support?
For example, if the other parent doesn’t pay child support for six years, you can only file contempt regarding the last three years’ worth of payments. If the noncustodial parent isn’t paying, be sure to file for contempt at least every three years to ensure you are eligible to receive all past due child support.
Can I deny visitation to the father of child support not paid?
A parent should not keep another parent from seeing their children even if child support is not paid. The courts will not refuse access because the parent does not pay support. And the parent with custody should not refuse access for this reason. There are other ways to get support from a non-paying parent.
