Who pays the cost of mediation?
Private mediation The cost of legal representation is the responsibility of each party. Usually each party pays an equal proportion of the costs associated with the mediation, although other arrangements can be agreed by the parties or ordered by the Court.

CJC mediations are generally made ‘in good faith’ and will only be enforceable if all parties agree to sign a legally binding document. There are some exceptions to this, such as where mediation is court-ordered.

To determine their desired outcome, the mediator can simply ask, “What exactly are you looking for in this deal?” The mediator should try to determine if the parties’ wants are common, different or opposed.
