Can Mother stop child support?
Even if the parents reconcile, child support is not usually automatically terminated. However, either parent can petition to end the child support order with the court. The court has the discretion to decide whether or not to end the order.
Is there always child support in a divorce?
Do both parents have to support their children financially after a separation or divorce? Yes. Your children have a legal right to financial support from both parents, and you both have a legal responsibility to provide this support. A separation or divorce does not change that ongoing obligation.
Can child support be taken from a new spouse?
While the court can garnish the wages of the child support obligor, the court cannot look to a new spouse’s income to satisfy a child support judgment. However, the new spouse can voluntarily offer to assist with the payments of old or current child support payments if he or she wishes to provide assistance.
